Presidential Regulation (Peraturan Presiden, Perpres) No. 5 of 2025, issued by the President of Indonesia, governs enforcement in forest areas against any person, including businesses, carrying out mining, plantation and/or other activities in forest areas without complying with permit requirements. It establishes the Forest Area Enforcement Task Force (Satgas PKH) under the President, involving various ministries and agencies, including the Ministry of Agriculture through its Directorate General of Plantations. Oil palm and vegetable oil plantation businesses whose land lies within forest areas may become subject to enforcement under this regulation.
Key points
- Enforcement takes three forms: collection of administrative fines, reclamation of forest areas (Penguasaan Kembali Kawasan Hutan) and/or asset recovery.
- Plantation activities in conservation or protection forests without a business licence are subject to administrative fines, criminal sanctions and reclamation.
- Plantation activities in production forests that do not meet business licence requirements are subject to administrative fines and may be subject to reclamation.
- Business licences obtained unlawfully remain subject to administrative fines and reclamation, in addition to legal proceedings under applicable law.
- Forest area enforcement does not remove the criminal liability of businesses under applicable laws and regulations.
- Enforcement is coordinated by the cross-ministry/agency Task Force, with the Minister of Defence as Chair of the Steering Committee and with the involvement of the Ministry of Agriculture and the Ministry of Forestry.
Who it affects
Mining, plantation (including oil palm) and other businesses operating in forest areas without proper permits.
